Terms & Conditions

1. Scope

These Terms and Conditions apply to all contracts between CMS Update and its customers for CMS update and migration services.

2. Contract Conclusion

A contract is concluded by written acceptance of an offer. The inquiry via the contact form does not yet constitute a binding offer.

3. Scope of Services

3.1 CMS Updates

We perform updates of Content Management Systems (TYPO3, WordPress, Drupal, Joomla, Contao, Craft CMS) to the desired version.

3.2 Included Services

• Analysis of current installation
• Backup of data and database
• Update of CMS core
• Review and update of compatible extensions/plugins
• Testing of updated installation
• Documentation of work performed

4. Prices and Payment

4.1 Pricing

Prices are individually calculated according to effort and specified in the quote. All prices are in CHF plus VAT.

4.2 Payment Terms

Invoices are payable within 30 days of invoice date without deduction.

5. Customer Obligations

The customer provides the following access and information:

• FTP/SSH access to web server
• Database access
• Backend access to CMS
• Information about custom extensions/plugins

6. Warranty

We warrant that the update is performed professionally and the website is functional after the update. Errors caused by custom code or incompatible third-party extensions are excluded.

7. Liability

We are only liable for intent and gross negligence. Liability is limited to typically foreseeable damage. A complete backup is created before each update.

8. Applicable Law

Swiss law applies. Place of jurisdiction is Zurich.
